In Elena Svenson v. Michael Krichevsky, the firm not only successfully represented Ms. Svenson in her request for monthly child support payments but also weathered several lawsuits from Ms. Svenson’s ex-partner, whose obligation to provide child support so distressed him that he targeted attorney Yonatan Levoritz directly.
In the initial case, Ms. Svenson sought child support after her ex-partner walked out on both her and their son. During their separation, Ms. Svenson’s ex-partner claimed that he earned little money, but the firm was able to show the Court that he quickly sold his BMW and even went so far as to quit his job, all in an effort to reduce or perhaps avoid altogether his obligation to pay child support.
The Family Court of King County ultimately sided with Ms. Svenson and ruled that child support is based upon an individual’s earning potential, not the amount of money an individual makes at the time of trial. This practice ensures that people like Ms. Svenson, who was a college student at the time of this dispute, have the necessary resources to take care of their children—regardless of whether their former partner misrepresents or temporarily reduces his earning capacity at the time of trial. In Ms. Svenson’s case, the judge awarded her over $2,000 per month to care for her son, and wrote that her former partner had attempted “to delay and evade a final determination of his obligation on their merits, both as to paternity and child support.” Due to this dilatory behavior, Mr. Krichevsky was ordered to pay all of the firm’s legal fees.
In response, Mr. Krichevsky accused the judge of bias and went so far as to file a lawsuit against Yonatan Levoritz. That suit was quickly dismissed. Mr. Krichevsky then filed a second lawsuit that was virtually identical to the first. That lawsuit was also dismissed. Then, when a financial institution sued Mr. Krichevsky for failure to pay his credit card bills, he asked the court to name Yonatan Levoritz as a responsible party. That request was also dismissed.
