Child Neglect

Representing families accused of child abuse or neglect

While child neglect and abuse remain a serious problem plaguing our society, there are numerous instances where an innocent person is accused of terrible acts. Child Protective Services (CPS) and the Administration for Children’s Services (ACS) function to protect children in the state of New York. These agencies are very proactive in the battle against child abuse and neglect. If you are being contacted by either of these agencies, it is imperative that you contact an attorney immediately. The thought of losing custody of your child or children after an ‘investigation’ is one of the most alarming things you can imagine. If you are facing the threat of having your children taken away from you, we can help preserve your parental rights. Contact The Levoritz Law Group for a consultation.

I did nothing wrong, why was I reported?

There are numerous instances when an innocent person can quickly become the subject of a child abuse or neglect report. One of the most significant factors in these cases is a simple misunderstanding that is witnessed and reported. This can include an act witnessed out of context, injuries that a person wrongly believes is neglect, and even a child being overheard saying something misconstrued. Another major factor is the difference in parenting. There are many times where one’s parenting style clashes with another, leading that person to take the unnecessary step of calling child protective services. Possibly the most egregious example is just an angry neighbor, ex-spouse, or acquaintance trying to plot revenge. Even though it seems far-fetched, a good portion of unfounded CPS/ACS reports stems from anger and the exploitation of the state’s eager action. Whatever your case may be, if you are wrongly accused of child abuse or neglect, contact The Levoritz Law Group.

Mandated reporters

Another major factor in CPS and ACS cases against innocent people are the obligation of mandated reporters. Certain professionals are considered “mandated reporters” in the state of New York. They are legally obligated to report any inkling of neglect or abuse. So, as stated before, misunderstandings can lead to terrible results for innocent parents. Some of these professionals include:

  •     School administrators and educators
  •     Medical Professionals
  •     Social Workers
  •     Law enforcement

When a report is filed

Even the most innocent people are vulnerable to a filed CPS/ACS report. Child protective service agencies are obligated to investigate every allegation of abuse or neglect within 24 hours of the filing. They will assess the safety of the child in the home and with the parents in question. This is mandatory. The state has 60 days to determine if the case is “indicated” or “unfounded.”
