During the mediation stage, only you and your spouse can make legal decisions about your divorce. This makes the divorce process speedy and seamless. However, if you can’t agree, the case will proceed to trial, where a judge will have the final say.
In New York City, the tax consequences for spousal support payments depend on the year the divorce was finalized. For a divorce that was finalized in 2026, the spouse paying spousal support payments can’t deduct them on their taxes, and the receiving spouse doesn’t report the spousal support payments as part of their income.
New York City Courts calculate alimony payments by using two different formulas, one used for those paying child support and another for cases where there are no children. For cases without children, the courts calculate 30% of the paying spouse’s income and subtract 20% of the receiving spouse’s income. They’ll then calculate 40% of the spouse’s combined income, subtracting the receiving spouse’s income.
Whichever result is lower is what the final spousal support payment will be.
In Brooklyn, the formula used to calculate spousal support payments for those also paying child custody is similar to that for those not paying child support. The courts take 20% of the payor’s income, subtracting 25% of the payee’s income. They then take 40% of the combined income, minus the payee’s income. The lower result is used.
Courts typically use an income cap as the highest limit when determining support, meaning only $241,000 of spousal income will be factored.
